JONESBORO, Ark. — A parolee accused of firing a gun from the passenger window of a vehicle leaving a Jonesboro club faces a felony firearm charge and a $100,000 bond.
Robert Lee Posey was arrested following the July 24 incident near Fair Park Boulevard, according to a probable cause affidavit filed in Craighead County Circuit Court.
The officer who submitted the affidavit reported working uniformed security at 2801 Fair Park Blvd. when a Pontiac G6 left the parking lot and traveled north. The officer said he heard a gunshot coming from the passenger side of the vehicle.
The officer pursued the Pontiac and reported that it initially failed to stop and attempted to evade him through traffic. The officer caught up with the vehicle near Bittle Street and Creek Drive, where a traffic stop was conducted.
Posey was allegedly seated in the front passenger seat. The affidavit identified him as a convicted felon who was on active parole with a search waiver on file.
Posey complied when asked to exit the vehicle, police said. During a search, the officer allegedly found a loaded 9 mm handgun and a spare magazine stuffed beneath the front passenger seat where Posey had been sitting.
Posey denied knowing about the firearm, according to the affidavit.
The driver reportedly told police she did not know Posey had a gun until he pulled it out and fired a round through the window as they were leaving the club.
Posey is charged with possession of a firearm by certain persons, a Class B felony, and discharging a firearm within city limits, a municipal ordinance violation. The felony charge is punishable by five to 20 years in prison and a fine of up to $15,000.
His bond was set Monday at $100,000 cash or surety. The court record noted that Posey was on parole and referenced his prior felony history.
Posey’s next court appearance is scheduled for 8:30 a.m. Aug. 21 at the Craighead County Courthouse.
Posey is presumed innocent unless and until proven guilty.
