JONESBORO, Ark. — A woman is facing a felony charge for an alleged battery of a young child, but her parents believe she is innocent, according to her attorney.
The investigation began on Sept. 26, according to the probable cause affidavit. Jonesboro officers responded to Miracle Kids Daycare, 1900 Stillwater Drive, about an incident with the caller’s three-year-old child.
An officer reviewed the video footage from inside the classroom and reported the teacher, identified as Elisabeth Gates, snatched the child by the left arm after she spilled milk. She then dragged the child to the corner of the room. The child tries to get up and walk away but Gates pushes her back down to the floor.
The officer noted in his report there was redness and scratches on the child’s arm. The detective observed the same when reviewing body camera footage.
The affidavit says on October 2, Gates came to the police department for an interview. Detective Madison Dobbs read her Miranda rights, reporting that Gates agreed to speak without an attorney present.
Elisabeth Gabrielle Gates, 30, of Alicia, was arrested and taken to Craighead County Detention Center. Judge David Boling set bail at $7,500 cash or surety, per the prosecutor’s recommendation. Randel Miller, representing Gates, appeared in court on her behalf, along with her parents.
Her next court appearance is scheduled for 8:30 a.m. on November 14.
Her parents feel very strongly she is not guilty of a criminal offense, Miller told NEA Report. As it was still early in the legal process, Miller had not yet reviewed the evidence to comment further.
All suspects are innocent until proven guilty in a court of law.
