Defendants Deny Wrong-Doing in Vape Lawsuit

IZARD COUNTY, Ark. – The primary defendants in a lawsuit alleging the sale of vape pens containing an illegal amount of THC have filed responses in court denying any wrong-doing in the case.

On February 2, 2024, Jordan’s Kwik Stop responded through their attorney, James D. Robertson. In the answer, Jordan’s denied any wrong-doing or knowledge of an alleged unlawful amount of THC in the vape pens.

“The Defendant affirmatively pleads that it had no knowledge whatsoever of any potential illegal conduct and to that end, punitive damages would be unavailable against it,” the answer from Jordan’s says.

The quick stop chain is seeking legal fees and court costs associated with the case from the plaintiff.

On February 13, Alliance Hemp Company, through attorney Grace Keegan Johnson, filed their response to the lawsuit, also denying any wrong-doing. The manufacturer acknowledged over 0.3-percent of D9 by dry weight would make a cannabis product illegal.

Like Jordan’s, they are also seeking attorney fees to be paid for by the plaintiff.

The original lawsuit was filed on Wednesday, December 27 in Izard County Circuit Court by Nicole Long and others similarly situated, represented by Sutter & Gillham of Little Rock. It targets Jordan’s Kwik Stop and Alliance Hemp Company, the manufacturer of the products in question.

The complaint states that each defendant manufactures, tests, distributes, markets, or sells D8 Vape pens in Izard and Jackson counties. The products are warranted as compliant with the Hemp Farming Act of 2018, meaning that they contain no more than hemp-derived .3% Delta-9 THC by dry weight. But the lawsuit alleges this representation is false.

The lawsuit also claims the manufacturer was aware and sought out a fake certificate of authenticity from labs that are also listed as defendants in this case.

The claim seeks class action status for the thousands who have purchased one or more of the Delta-8 vape pens in question.
