LONOKE COUNTY, Ark. — A judge has formally dismissed the murder case against Lonoke County sheriff candidate Aaron Spencer with prejudice, according to a court order filed Monday.
Special Circuit Judge Ralph Wilson Jr. signed the order June 8, directing that Spencer be released from all bond obligations and conditions associated with the case. The filing follows Wilson’s June 4 ruling granting Spencer’s motion to dismiss.
“Upon Order of the Court, this case is hereby dismissed with prejudice,” the order states.
A dismissal with prejudice prevents prosecutors from refiling the charge unless the ruling is overturned on appeal.
Spencer had been charged with second-degree murder in the 2024 shooting death of Michael Fosler.
Wilson’s earlier dismissal order cited due process violations raised by Spencer’s attorneys. Defense filings alleged investigative misconduct and focused heavily on the handling of evidence, including the loss of an SD card from a dash camera located in Fosler’s pickup truck.
Fosler had been free on bond at the time of the shooting after being accused of raping Spencer’s underage daughter in July 2024.
The June 8 order formally closes the criminal case and releases Spencer from all conditions tied to his bond.
The State of Arkansas may seek appellate review of the dismissal.
