JONESBORO, Ark. — Jonesboro police arrested a Brookland defendant after an alleged break-in and attack during a domestic disturbance earlier this week, according to a probable-cause affidavit.
Sean C. Foley, 39, of Brookland, faces a Class Y felony charge of aggravated residential burglary. He also faces misdemeanor counts of third-degree domestic battery, first-degree interference with emergency communication, second-degree endangering the welfare of a minor, second-degree criminal mischief, and criminal trespass. His next court date is Dec. 16.
Officers were dispatched on Nov. 12 to a home on Stevens Street, according to the probable cause affidavit. The alleged victim told police she was preparing to leave the residence when her ex-boyfriend, identified as Foley, entered without permission.
She said she asked Foley to leave, but instead, he took her phone and told her he was there to pick up their child. The victim said she moved between Foley and the child to prevent him from taking the child.
After the two were separated, the affidavit says the victim tried to retrieve her phone. That’s when Foley allegedly wrapped his arm around her neck, placing her in a chokehold. She told officers she was able to break free but fell to the ground during the struggle. Foley then reportedly tried to get on top of her, prompting her to kick him. The affidavit states that Foley lost his balance and fell.
The victim yelled for help, and Foley left the residence. She reported that her phone was damaged during the incident, preventing her from calling the police. She contacted her mother through a laptop, and her mother called the authorities.
Officers noted injuries to the victim’s arm and neck. She also told police that Foley had previously been banned from the residence and that she had full custody of their child.
Foley was located a short time later, taken into custody without further incident, and transported to the Craighead County Detention Center.
Bail was set at $75,000 cash or surety by District Judge David Boling, who noted Foley may be a candidate for mental-health court.
All suspects are innocent until proven guilty in a court of law.
