LITTLE ROCK, Ark. — The Arkansas State Medical Board voted Friday to revoke the license of Dr. David Diffine, the physician seen nude and engaged in a sex act in a viral online video.
Diffine faced the board in a disciplinary hearing on Friday. NEA Report was the only Northeast Arkansas media outlet to attend the more than four-hour hearing.
In all, the state attorney general’s office showed the board 17 videos showing Diffine walking around his Blytheville clinic in the nude. They alleged Diffine violated the Medical Practices Act.
The proceedings got off to a late start as the hearing officer apologized for his tardiness, saying he had confused the time of the hearing. Attorney Randel Miller accompanied Diffine to the hearing, but did not represent him during the actual hearing. The board refused to allow Miller to offer procedural advice to Diffine during the hearing. Diffine represented himself, calling two former staff members, one of whom was seen in the video in question, and a colleague as witnesses.
Both of the employees who testified reported that they never felt sexually harassed by Diffine. The witness who appeared in the videos also said neither she nor her colleagues were forced to be at the clinic the night the videos were recorded on security cameras. Board members seemed skeptical during portions of her testimony, including when she stated she was working late but was not officially on the clock.
Diffine’s other former employee, who served as office manager working for Diffine for a total of 9 years, testified that she never saw inappropriate behavior during her time of employment.
The medical board issued an emergency suspension of Diffine’s license in October 2024. An anonymous complaint in July 2024 contained the then-five-year-old security videos taken in July 2019 inside Diffine’s office. One of these videos showed Diffine engaged in a sexual act with one of the women while two other women looked on and commented.
The complainant, who contacted the board, accused Diffine of using “his position of power, sexual grooming, and salary increases to groom employees and patients into repulsive sexual acts.” The complaints also claimed the videos took place during office hours. Diffine adamantly denies everything contained in the complaint, except the videos.
“The only thing that was true was the video,” Diffine said.
At Friday’s hearing, the medical board voted to revoke Diffine’s medical license. The vote was not unanimous. The revocation is in effect for at least five years, after which time Diffine will have the opportunity to request reinstatement from the board. The revocation is also open to appeal prior to that five-year mark.
Diffine told NEA Report he is unsure of what the future holds for him. He said he isn’t sure whether he will pursue an appeal or he will choose a new career path.
Diffine still holds a valid medical license in Missouri.
