JONESBORO, Ark. — An area doctor who had his license revoked after being seen walking around naked and performing sex acts in his office has appealed the decision by the Arkansas State Medical Board.
Dr. David Diffine, the physician seen nude and engaged in a sex act in a viral online video, faced the board in a disciplinary hearing in August. The medical board voted to revoke Diffine’s medical license. The vote was not unanimous. The revocation is in effect for at least five years, after which time Diffine will have the opportunity to request reinstatement from the board. However, Diffine is not giving up without a fight.
On October 2, 2025, he filed a petition for review of an administrative adjudication in Craighead County Circuit Court against the members of the state medical board.
His complaint alleges that the order by the board falls short of the requirements found in Ark. Code Ann. § 25-12-210(b)(2) concerning findings of fact and conclusions of law. The order, Diffine asserts, was not in measure with the alleged violations of the Medical Practices Act. Diffine’s claim says this was his first final disciplinary action and first finding of a violation of the act.
Additionally, the Board prejudiced the hearing by releasing evidence of the investigation to the public prior to the hearing and FINAL disciplinary action in violation of the Arkansas Freedom of Information Act. Ark. Code Ann. § 25-19-105(b)(6) and the Medical Practice Act. Ark. Code Ann. § 17-95-107. Furthermore the video evidence entered as evidence by the Board was intimate material of a revenge porn nature and it’s use as evidence and its release to the public prior to the hearing is by definition a criminal act under Ark. Code Ann. § 5-26-314 as well as a violation of the FOIA due to its intimate nature providing for an exemption under Ark Code Ann. § 25-19-105(b)(2),(b)(6).
The petition claims that Diffine was persecuted for his spiritual belief in nudism. The petition says his First and Fourteenth Amendment rights were violated when he was asked if he was still practicing those beliefs.
Diffine claims he never received service (personally or by mail) of the action taken against him by the board, as required by law.
Petitioner considers himself injured by final agency action. This petition is filed within thirty days of September 3,2025; however, in violation of the Act, he has yet to be served with the Order.
The nudist doctor is seeking to have the court reverse the board’s decision and restore his medical license without restriction.
